  • Unforeseen conditions are discovered during construction
  • Customer requests modifications to the original plan

6. Payment Terms

Deposit Requirements

  • A minimum deposit of 30% is required to initiate any project
  • Deposit must be paid before work begins
  • Deposit is non-refundable once materials have been ordered

Progress Payments

  • 30% payment upon completion of demolition/rough-in phase
  • 30% payment upon completion of installation phase
  • Final 10% payment upon project completion and customer satisfaction

Payment Methods

We accept the following payment methods:

  • Cash
  • Check
  • Credit/Debit Cards (Visa, MasterCard, American Express)
  • Bank Transfers
  • Financing options available for qualified customers

Late Payments

Payments not received within the specified timeframe will be subject to a late fee of 1.5% per month on the outstanding balance. Work may be suspended until payment is received.

7. Project Timeline and Scheduling

While we make every effort to complete projects within the estimated timeframe, actual completion times may vary due to:

  • Weather conditions (for exterior work)
  • Material availability and delivery delays
  • Unforeseen structural issues
  • Customer-requested changes
  • Permit processing times
  • Inspection schedules

We will communicate any timeline changes to you as soon as they are identified.

8. Customer Responsibilities

As a customer, you agree to:

  • Provide clear access to work areas
  • Remove personal belongings from work areas
  • Make decisions and approvals in a timely manner
  • Obtain necessary permits and approvals (unless handled by us)
  • Ensure pets and children are kept away from work areas
  • Provide utility access as needed
  • Notify us of any existing issues or concerns before work begins
  • Approve change orders in writing before additional work proceeds

9. Permits and Regulations

Homecraft Enhancements will obtain all necessary permits for projects where we are responsible. Customer acknowledges that:

  • Some projects require city/county permits
  • Inspections may be required at various stages
  • Work must comply with local building codes
  • Permit fees are not included in estimates unless specified
  • Compliance with HOA regulations is the customer's responsibility

10. Change Orders

Any changes to the original project scope must be documented in a written change order that includes:

  • Description of the change
  • Impact on timeline
  • Additional costs (if applicable)
  • Customer and contractor signatures

No changes will be made without customer approval in writing.

11. Cancellation and Refund Policy

Cancellation by Customer

  • Cancellations made 14+ days before start date: Full refund of deposit
  • Cancellations made 7-13 days before start date: 50% refund of deposit
  • Cancellations made less than 7 days before start date: No refund
  • Cancellations after work begins: Customer responsible for all work completed and materials ordered

Cancellation by Homecraft Enhancements

We reserve the right to cancel any project due to:

  • Safety concerns
  • Non-payment
  • Unforeseen circumstances beyond our control
  • Customer harassment or inappropriate behavior

In such cases, we will provide a full refund of any unused deposits.

12. Warranty Terms

Workmanship Warranty

  • 5-year warranty on all labor and workmanship
  • Covers defects in installation and construction
  • Does not cover normal wear and tear or damage from misuse

Material Warranty

  • Manufacturer warranties apply to all materials
  • Warranty periods vary by product (typically 1-25 years)
  • We will assist with warranty claims when needed

Warranty Exclusions

The warranty does not cover:

  • Damage caused by accidents, abuse, or misuse
  • Normal wear and tear
  • Improper maintenance by customer
  • Modifications or repairs by unauthorized personnel
  • Acts of nature (floods, earthquakes, etc.)
  • Failure to follow care instructions

13. Limitation of Liability

Homecraft Enhancements shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services
  • Unauthorized access to or use of our servers
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our website
  • Errors or omissions in any content
  • Delays in service or project completion

Our total liability shall not exceed the amount paid for the specific service in question.

14. Indemnification

You agree to indemnify, defend, and hold harmless Homecraft Enhancements, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right
  • Any claim that your use of the website caused damage to a third party

Homecraft Enhancements shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, strikes, riots, government actions, natural disasters, or other force majeure events.

20. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

21. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

22. Entire Agreement

These Terms constitute the entire agreement between you and Homecraft Enhancements regarding the use of the website and services, superseding all prior agreements and understandings.
